Unfortunately, many times we have to deal with a recipient or sub-recipient that's non-compliant with either national policy requirements, the general terms, or specific terms and conditions of a federal award. And when we need guidance on how to address non-compliance, we go to the Remedies for Non-Compliance section. This section is covered under the sub-sections 339 to 343.
Federal awarding agencies and pass-through entities must take prompt action when recipients or sub-recipients fail to comply with their federal award requirements. Remedies can include posing additional conditions on the award, requiring corrective actions, withholding payments, disallowing costs, suspending or even terminating the award. Additionally, not only do federal agencies need help in any situations, but pass-through entities need help as well because sub-recipients must be monitored, and any identified non-compliance must be addressed to prevent recurrence of these issues for the recipient or the sub-recipient.
These remedies ensure accountability, protect federal funds, and help recipients achieve program objectives while maintaining compliance with applicable laws, regulations, and national policy requirements, as well as the general terms and the specific terms and conditions of the federal award.
